Membership Agreements

1. Parties

a) Medsen Medical Healthcare Biyomedikal Sağlık Limited Şirketi, located at Serhat Mahallesi 1323. Cadde Vural Prestij Konutları 1A/15 Yenimahalle Ankara, which operates the www.elens.ae website. (Hereinafter referred to as “e-lens”).

b) Internet user who is a member of the www.elens.ae website (“Member”)

2. Subject of the Agreement

The subject of this Agreement is to determine the terms of use of the www.elens.ae website owned by e-lens.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided by him while becoming a member of the www.elens.ae website is correct before the law, and that he will compensate e-lens for all damages it may suffer due to the inaccuracy of this information in full and immediately.

3.2. The member cannot give the password given to him/her by e-lens to other persons or organizations, the member has the right to use the said password. For this reason, e-lens reserves all responsibilities that may arise and all claims and demands that may be made against e-lens by third parties or authorized authorities, and all kinds of compensation and other claims arising from the unauthorized use in question.

3.3. The member accepts and undertakes to comply with the provisions of the legal legislation and not to violate them while using the www.elens.ae website.

Otherwise, all legal and criminal liabilities that may arise will bind the member completely and exclusively.

3.4. The member cannot use the www.elens.ae website in any way that disrupts public order, is against general morality, disturbs and harasses others, for an illegal purpose, or infringes on the intellectual and copyrights of others. In addition, the member cannot engage in activities and actions that prevent or make it difficult for others to use the services (spam, virus, trojan horse, etc.).

3.5. The ideas and thoughts declared, written and used by members on the www.elens.ae website are entirely the members' own personal opinions and are binding on the opinion owner. These opinions and thoughts have no connection or relation with e-lens. e-lens has no responsibility for the damages that third parties may suffer due to the ideas and opinions expressed by the member and for the damages that the member may suffer due to the ideas and opinions expressed by third parties.

3.6. e-lens shall not be responsible for the reading of member data by unauthorized persons and for damages that may occur to member software and data. The member has accepted in advance not to claim compensation from e-lens for any damages that may be suffered due to the use of the www.elens.ae website.

3.7. The member has accepted not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal liabilities arising from this shall belong entirely to the member.

3.8. The member who violates one or more of the articles listed in this membership agreement shall be personally and legally liable for this violation and shall exempt and justify e-lens from the legal and penal consequences of these violations. In addition; if the incident is brought to the legal field due to this violation, e-lens reserves the right to claim compensation from the member due to non-compliance with the membership agreement.

3.9. e-lens always has the right to unilaterally delete the member's membership and delete the customer's files, documents and information when necessary. The member accepts this disposition in advance. In this case, e-lens has no responsibility.

3.10. The software and design of the www.elens.ae website are the property of e-lens, the copyright and/or other intellectual property rights related to them are protected by the relevant laws and they cannot be used, acquired or changed by the member without permission. Other companies and products mentioned on this website are the trademarks of their owners and are also protected within the scope of intellectual property rights.

3.11. Some information may be collected by e-lens for the purpose of improving and developing the www.elens.ae website and/or within the framework of legal regulations, such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time the site was accessed, the pages accessed while on the site and the Internet address of the Web site that provides direct connection to the site.

3.12. e-lens may use members' personal information in studies regarding the special preferences and interests of its users in order to provide better service to its users, improve its products and services and facilitate the use of the site. e-lens reserves the right to keep records of the member's movements on the www.elens.ae website.

3.13. The person who becomes a member of e-lens declares and accepts that he/she allows product and service promotions, advertisements, campaigns, advantages, surveys and other customer satisfaction applications to be presented to him/her by all companies affiliated with the owners and/or partners of e-lens and Medsen Medical Healtcare Biomedical Health Limited Company within the scope of the applications that are in effect and/or will be in effect. The member declares and accepts that he/she allows the collection of personal and shopping information and shopping and/or consumer behavior information that he/she has provided in the past and/or will provide in the future while becoming a member of e-lens and/or through other means for the above purposes, to be shared with all companies affiliated with the owners and/or partners of Medsen Medical Healtcare Biomedical Health Limited Company, and to be used and archived by all companies affiliated with the owners and/or partners of e-lens and Medsen Medical Healtcare Biomedical Health Limited Company. Unless the Member states otherwise, the Member declares and accepts that he/she allows the data to be collected after the membership ends, to be shared with all companies affiliated with the owners and/or partners of Medsen Medical Healthcare Biomedical Health Limited Company, to be used and archived by all companies affiliated with the owners and/or partners of e-lens and Medsen Medical Healthcare Biomedical Health Limited Company. Unless the Member states otherwise, the Member declares and accepts that he/she allows all companies affiliated with the owners and/or partners of e-lens and Medsen Medical Healthcare Biomedical Health Limited Company to contact him/her using communication channels such as internet, telephone, SMS, etc. The Member declares and accepts that he/she will not claim any direct and/or indirect material and/or moral negative and/or positive damages due to the collection, sharing, use, archiving and access to the above-mentioned information, and that he/she will not hold the companies affiliated with the owners and/or partners of e-lens and Medsen Medical Healthcare Biomedical Health Limited Company responsible. Members can access detailed information regarding their personal data via info@elens.ae.

3.14. e-lens may disclose the member's personal information when requested as a legal obligation or when it believes in good faith that it is necessary to (a) act in accordance with legal requirements or comply with legal processes served on e-lens; (b) protect and defend the rights and property of e-lens and the www.elens.ae website family.

3.15. Measures have been taken within the available means to ensure that the www.elens.ae website is free from viruses and similar software. In addition, in order to ensure ultimate security, the user must provide their own virus protection system and provide the necessary protection. In this context, by entering the www.elens.ae website, the member accepts that they are responsible for all errors that may occur in their own software and operating systems and their direct or indirect consequences.

3.16. e-lens reserves the right to change the content of the site at any time, to change or terminate any service provided to users, or to delete user information and data registered on the www.elens.ae website.

3.17. e-lens may change, update or cancel the terms of the membership agreement at any time without any prior notice and/or warning. Any changed, updated or repealed provision shall be effective for all members on the date of publication.

3.18. The parties accept and declare that all computer records belonging to e-lens shall be taken as the sole and exclusive evidence in accordance with Article 287 of the Civil Procedure Code and that the records in question constitute an evidentiary contract.

3.19. e-lens, in accordance with this membership agreement, is authorized to send information e-mails to the e-mail addresses registered with it and information SMSs to the mobile phones of its members, and the member shall be deemed to have accepted the sending of information e-mails to his/her e-mail address and information SMSs to his/her mobile phone by approving this membership agreement. If the member wishes to stop receiving e-mails and/or SMS, they can cancel the e-mail and/or SMS sending process from the “Membership Information” section in the “Membership Services” section.

4. Termination of the Agreement

This agreement will remain in effect until the member cancels their membership or until their membership is canceled by e-lens. If the member violates any provision of the membership agreement, e-lens may cancel the member’s membership and terminate the agreement unilaterally.

5. Resolution of Disputes

Ankara Courts and Enforcement Offices are authorized in disputes regarding this agreement.

6. Enforcement

The member’s registration as a member means that the member has read all the articles in the membership agreement and has accepted the articles in the membership agreement. This Agreement has been concluded and entered into force mutually at the time the member becomes a member.
